Judge Keeps Northwell Health Retirement Plan Fee Suit Alive

On Tuesday, a former employee of Northwell Health Inc., Kaila Gonzalez, was granted permission to file an amended complaint in her proposed class action lawsuit under the Employee Retirement Income Security Act (ERISA). This came after Judge Rachel P. Kovner deemed Gonzalez’s original claims against the company regarding its mismanagement of their $5.6 billion retirement plan as viable.

Gonzalez had raised concerns about the plan’s administrative fees, specifically challenging the $60 per person, per year fee and the use of a single mutual fund. The judge found these allegations valid and ruled in Gonzalez’s favor.

This ruling represents a step towards holding Northwell Health Inc. accountable for its handling of the retirement plan and ensuring that employees are treated fairly and lawfully in terms of their financial security.
